The partnership between VALOPTIM and FNAIM is born of a desire to confirm the professional prerogatives and identity of the estate agent
It reinforces the status of agencies by quality of the service they provide and the relationships they create.

ARTICLE 33.
CODE OF ETHICS AND GOOD PRACTICE

33.1. General principles
In accordance with its statutes, the object of the Federation is to:
• represent and defend the professional and economic interests of the members of subscribing organisations at all levels, including within the sphere of the European Union;
• implement all actions, measures or steps likely to develop the good name or status of the above-mentioned professions, and also to promote its own public image and reputation;
• maintain fraternal links between members of the federation’s organisations;
• develop a policy of partnership with representative trade union organisations who sign a protocol including, notably, a specific code of practice providing consumers with a quality service;
• investigate all questions relating to the law relative to and the practice of the professions and activities which it represents, or which can influence these, and particularly to investigate all legal, statutory, economic and social measures and reforms;
• provide training, and specifically professional or on-going training, and preparation for and entrance to professional examinations.
Professionals who belong to FNAIM believe that the legitimacy of their professional existence and the confidence that their clients have in them is based on their respect for the policies, ethics and code of practice, which guarantee clients excellent levels of service and high moral standards

The Code of Ethics and Good Practice sets out these policies and can be used by FNAIM members as a basis for asserting their professionalism and enables them to demonstrate this to their clients using the concrete points of reference defined below
Estate agency professionals who belong to a professional organisation which is itself part of the National Estate Agency Federation – FNAIM are automatically bound by these rules.

33.2. Conforming to the law and to regulations
A professional who belongs to FNAIM works strictly in accordance with the current laws, decrees and regulations governing the profession, the statutes and rules of the FNAIM and the rules contained in the Code of Ethics and Good Practice.
In particular:
• S/he never discriminates against individuals based on their origin, sex, family situation, physical appearance, family name, state of health, handicap, genetic characteristics, moral values, sexual orientation, age, political opinions, trade union activities or actual or assumed membership or non-membership of a specific ethnicity, nation, race or religion.
• S/he never discriminates against legal entities for the above reasons as applied to the members or certain members of these entities.
• S/he ensures that regulations concerning money laundering are respected.
• S/he keeps up to date with the latest legal and regulatory developments which may concern his/her areas of activity.

33.3. Respect for the good name and the ethics of the profession
Each member of the FNAIM endeavours by his/her actions and discourse to promote the best possible image of the profession. S/he does not behave or act in such a way or make any omission that is liable bring the FNAIM, his/her own professional organisation or the profession as a whole into disrepute.
S/he carries out his/her work competently and conscientiously, with dignity, loyalty, sincerity and integrity and with the conviction that his/her professionalism is the best tool for earning recognition from clients.
S/he is careful to avoid any conflict of interests with his/her clients.

33.4. Promoting services offered
FNAIM members give a positive image to clients of the services which they offer and of the competences necessary to provide these services transparently and in total security.

33.5. Separation of trade union activities from professional activities
FNAIM members who have responsibilities within a trade union undertake not use these responsibilities for personal or commercial benefit.

33.6. Confidentiality
FNAIM members are bound by obligations concerning confidentiality and discretion.
They will therefore keep all information about the personal life or professional activities of clients and principles communicated to them, whether expressly or implicitly, secret.
By exception from the principles stated above, this obligation is waived:
• When a member is required to testify in court at the request of a judicial or administrative authority.
• When legal or statutory requirements oblige him/her to disclose all or part of the information held.
• When organising his/her own legal or disciplinary defence.

33.7. Involvement of staff
Members of FNAIM are responsible for ensuring that all their staff respect the principles of the Code of Ethics and Good Practice.

33.8. Publication of disciplinary action for educational purposes
In exemplary cases, disciplinary action taken may be published, in a non-nominative manner within FNAIM’s communication media, for educational and dissuasive purposes. The motives which justify the action taken will be stated within these publications.
